Azerbaijan bans import, production and sale of electronic cigarettes

The import, export, production, storage, wholesale and retail sale, and use of electronic cigarettes and their components are prohibited, APA reports.

This is reflected in the proposed amendment to the Law “On Tobacco and Tobacco Products,” was put up for discussion at today's session of the Milli Majlis.


According to the draft, nicotine-containing electronic cigarettes are included in the concept of tobacco products. An electronic cigarette is a product intended for the inhalation of vapor into the human body via the respiratory tract, whether containing nicotine or not, excluding food products, tobacco products, medicinal products, and medical devices, and intended for use through a device with or without a mouthpiece or other components, including a cartridge and a vial. The vial of electronic cigarettes may be used one or more times, or they may be refilled with disposable cartridges.

Heated tobacco products will not be considered electronic cigarettes. A heated tobacco product is a product consisting of tobacco (a tobacco mixture) and non-tobacco components used in its production, intended for the inhalation of a nicotine-containing aerosol generated during the heating process—without ignition and without the formation of tobacco smoke—into the human body via the respiratory tract.

Thus, nicotine-containing electronic cigarettes are classified as tobacco products, with their circulation being prohibited. Clarification of definitions and the introduction of new concepts will enable more precise classification and differentiation in legal practice of tobacco products, including heated tobacco products, as well as electronic cigarettes.

At the same time, within the framework of harmonization, relevant amendments are being made to the Tax Code of the Republic of Azerbaijan and to the Law of the Republic of Azerbaijan “On Advertising.” These include the removal of “single-use electronic cigarettes” and “liquids for electronic cigarettes” from the list of excisable goods and, consequently, the abolition of tax rates, as well as the alignment of advertising bans with the new definitions.

The draft law was put to a vote and adopted in the first reading.

If the law is passed, it will come into force on February 1, 2026.
