Prosecutor's Office protests verdict on Oleg Bakinsky and former Ukrainian Deputy Minister

An appeal and protest have been filed against the verdict regarding Ukrainian millionaire Oleg Krapivin, known in criminal circles by the nickname “Oleg Bakinsky,” and Konstantin Kucher, who were arrested in Azerbaijan on hooliganism charges, APA reports.

The appeal has been submitted to Judge Murad Mammadov of the Baku Court of Appeal.

The preliminary hearing is scheduled to take place on September 21.

Recall that according to the verdict of the Baku Court on Grave Crimes, Oleq Krapivin was sentenced to 2 years and 6 months of imprisonment. Article 70 of the Criminal Code was applied in his case, and with a probation period of 6 months, his sentence was considered conditional. Konstantin Kucher was acquitted under Article 178.4 of the Criminal Code which he was charged with. However, under Article 221.3, which he was charged with, he was definitively sentenced to 2 years and 6 months of imprisonment.

The state prosecutor, in his speech, requested the imprisonment of Konstantin Kucher for 14 years and Oleq Krapivin for 3 years.

Note that "Oleg Bakinsky" was detained by the police in Baku last year on charges of hooliganism against a Russian citizen. He was charged with a final charge under Articles 127.2.3 (Intentional infliction of less serious harm to health, committed in a generally dangerous manner or with hooligan intent) and 221.3 (Hooliganism committed with the use of weapons or objects used as weapons, accompanied by the use of force against the victim, or the destruction or damage of another person’s property) of the Criminal Code. The preventive measure of arrest chosen for him during the preliminary investigation was replaced with a preventive measure of house arrest during the trial.

Along with Oleg Bakinsky, Konstantin Antonovich Kucher, who served as Deputy Minister of Defense Industry of Ukraine for Aviation Affairs in 2010-2011, is also found guilty in the criminal case. He is charged under Articles 178.4 (fraud, especially when committed with causing large-scale damage) and 221.3 (hooliganism, committed with the use of weapons or objects used as weapons, accompanied by the use of force against the victim, or the destruction or damage of another person's property) of the Criminal Code.

The victims are "Aviazapchast" OJSC, "Promyshlennye Postavki Kazakhstan" LLC, and Zakharenkov Valery Nikolayevich.
